PRIVACY POLICYAstana, “20” January 2026This Privacy Policy of personal data (hereinafter referred to as the “Privacy Policy”) applies to all information that the online store “zagotovki.kz”, located at the domain name https://zagotovki.kz, may receive about the User while using the online store’s website, programs, and products.1. DEFINITIONS1.1. The following terms are used in this Privacy Policy:1.1.1. “Administration of the Online Store Website” (hereinafter referred to as the “Website Administration”) – authorized employees managing the website, acting on behalf of "ИП Шемелина Д.М.", who organize and/or carry out the processing of personal data, and determine the purposes of personal data processing, the composition of personal data to be processed, and the actions (operations) performed with personal data.1.1.2. “Personal data” – any information relating directly or indirectly to an identified or identifiable natural person (subject of personal data).1.1.3. “Processing of personal data” – any action (operation) or set of actions (operations) performed with or without the use of automation tools with personal data, including collection, recording, systematization, accumulation, storage, clarification (updating, modification), extraction, use, transfer (distribution, provision, access), anonymization, blocking, deletion, destruction of personal data.1.1.4. “Confidentiality of personal data” – a requirement mandatory for compliance by the Operator or any other person who has gained access to personal data not to allow their disclosure without the consent of the personal data subject or other legal basis.1.1.5. “User of the Online Store Website” (hereinafter referred to as the “User”) – a person who has access to the Website via the Internet and uses the online store website.1.1.6. “Cookies” – a small piece of data sent by a web server and stored on the user’s computer, which the web client or web browser sends back to the web server in an HTTP request each time it attempts to open a page of the corresponding website.1.1.7. “IP address” – a unique network address of a node in a computer network built using the IP protocol.2 GENERAL PROVISIONS2.1. The use of the online store website by the User implies consent to this Privacy Policy and the conditions for processing the User’s personal data.2.2. In case of disagreement with the terms of the Privacy Policy, the User must stop using the online store website.2.3. This Privacy Policy applies only to the online store website zagotovki.kz. The online store does not control and is not responsible for third-party websites to which the User may navigate via links available on the online store website.2.4. The Website Administration does not verify the accuracy of the personal data provided by the User of the online store website.3 SUBJECT OF THE PRIVACY POLICY3.1. This Privacy Policy establishes the obligations of the online store website administration to maintain confidentiality and ensure the protection of personal data provided by the User upon request by the Website Administration during registration on the online store website or when placing an order for the purchase of goods.3.2. Personal data permitted for processing under this Privacy Policy are provided by the User by filling out the registration form on the online store website zagotovki.kz in the “Personal Account” section and include the following information:3.2.1. User’s last name, first name, patronymic;3.2.2. User’s contact phone number;3.2.3. Email address (e-mail);3.2.4. Delivery address of the goods;3.2.5. User’s place of residence.3.3. The online store protects data that is automatically transmitted during the viewing of advertising blocks and when visiting pages where a statistical script (“pixel”) is installed, including:- IP address;
- information from cookies;
- information about the browser (or another program used to display advertising);
- access time;
- the address of the page where the advertising block is located;
- referrer (the address of the previous page).
- 3.3.1. Disabling cookies may result in the inability to access parts of the online store website that require authorization.
- 3.3.2. The online store collects statistics about the IP addresses of its visitors. This information is used to identify and resolve technical issues and to control the legality of financial payments made.
- 3.4. Any other personal information not specified above (purchase history, browsers and operating systems used, etc.) is subject to secure storage and non-disclosure, except in cases provided for in clauses 5.2 and 5.3 of this Privacy Policy.
4. PURPOSES OF COLLECTING USER PERSONAL INFORMATION4.1. The Website Administration of the online store may use the User’s personal data for the following purposes:4.1.1. Identifying the User registered on the online store website to place an order and/or conclude a distance sale contract for goods (products) from the website: zagotovki.kz.4.1.2. Providing the User with access to personalized resources of the online store website.4.1.3. Establishing feedback with the User, including sending notifications and requests regarding the use of the online store website, provision of services, and processing requests and applications from the User.4.1.4. Determining the User’s location to ensure security and prevent fraud.4.1.5. Confirming the accuracy and completeness of personal data provided by the User.4.1.6. Creating an account for making purchases if the User has consented to the creation of an account.4.1.7. Notifying the User of the online store website about the status of the order.4.1.8. Processing and receiving payments, confirming tax or tax benefits, disputing a payment, determining the User’s eligibility for a credit line.4.1.9. Providing the User with effective customer and technical support in case of problems related to the use of the online store website.4.1.10. Providing the User, with their consent, with product updates, special offers, pricing information, newsletters, and other information on behalf of the online store or on behalf of the online store’s partners.4.1.11. Conducting advertising activities with the User’s consent.4.1.12. Providing the User with access to partner websites or services for the purpose of receiving products, updates, and services.5. METHODS AND TERMS OF PROCESSING PERSONAL INFORMATION5.1. The processing of the User’s personal data is carried out without limitation of time, by any lawful means, including in personal data information systems using automation tools or without using such tools. 5.2. The User agrees that the Website Administration has the right to transfer personal data to third parties, in particular, courier services, postal organizations, and telecommunications operators, exclusively for the purpose of fulfilling the User’s order placed on the online store website “zagotovki.kz”, including the delivery of the Goods. 5.3. The User’s personal data may be transferred to authorized bodies only on the grounds and in the manner established by the legislation of the Republic of Kazakhstan. 5.4. In case of loss or disclosure of personal data, the Website Administration informs the User about the loss or disclosure of personal data. 5.5. The Website Administration takes the necessary organizational and technical measures to protect the User’s personal information from unlawful or accidental access, destruction, alteration, blocking, copying, distribution, as well as other unlawful actions by third parties. 5.6. The Website Administration, together with the User, takes all necessary measures to prevent losses or other negative consequences caused by the loss or disclosure of the User’s personal data. 6. OBLIGATIONS OF THE PARTIES6.1. The User is obliged to: 6.1.1. Provide the personal data information necessary for using the online store website. 6.1.2. Update and supplement the provided personal data information in case of changes to such information.6.2. The Website Administration is obliged to: 6.2.1. Use the obtained information exclusively for the purposes specified in clause 4 of this Privacy Policy. 6.2.2. Ensure the storage of confidential information in secrecy, not disclose it without the prior written permission of the User, and also not carry out the sale, exchange, publication, or disclosure in any other possible way of the User’s personal data provided, except for clauses 5.2 and 5.3 of this Privacy Policy. 6.2.3. Take precautionary measures to protect the confidentiality of the User’s personal data in accordance with the procedures generally used for protecting such information in the existing business turnover. 6.2.4. Block the personal data relating to the corresponding User from the moment of the User’s request or the request of his/her legal representative, or the authorized body for the protection of personal data subjects, for the period of verification, in case of identifying inaccurate personal data or unlawful actions. 7. LIABILITY OF THE PARTIES7.1. The Website Administration that has not fulfilled its obligations is liable for losses incurred by the User in connection with the unlawful use of personal data, in accordance with the legislation of the Republic of Kazakhstan, except for cases provided for in clauses 5.2, 5.3, and 7.2 of this Privacy Policy. 7.2. In case of loss or disclosure of Confidential Information, the Website Administration is not liable if such confidential information: 7.2.1. Became publicly available before its loss or disclosure. 7.2.2. Was obtained from a third party before it was received by the Website Administration. 7.2.3. Was disclosed with the User’s consent. 8. DISPUTE RESOLUTION8.1. Before applying to court with a claim for disputes arising from the relations between the User of the online store website and the Website Administration, it is mandatory to submit a claim (a written proposal for voluntary settlement of the dispute). 8.2. The recipient of the claim, within 30 calendar days from the date of receipt of the claim, notifies the claimant in writing about the results of the claim consideration. 8.3. If an agreement is not reached, the dispute will be submitted for consideration to a judicial authority in accordance with the current legislation of the Republic of Kazakhstan. 8.4. This Privacy Policy and relations between the User and the Website Administration are governed by the current legislation of the Republic of Kazakhstan. 9. ADDITIONAL TERMS9.1. The Website Administration has the right to make changes to this Privacy Policy without the User’s consent. 9.2. The new Privacy Policy comes into force from the moment it is posted on the online store website, unless otherwise provided by the new edition of the Privacy Policy. 9.3. All suggestions or questions regarding this Privacy Policy should be submitted to the “Cooperation” section (specify the section of the online store website). 9.4. The current Privacy Policy is posted on the page at www.zagotovki.kz (store address).
